It is important for businesses to have a clear policy on background checks and to follow it consistently.
This policy should outline:
- The procedures for gaining the consent of all individuals prior to performing background checks;
- Explain the types of background checks to be run;
- Explain what types of charges or convictions will be considered;
- Ensure confidentiality of information obtained;
- Comply with local, state, and federal laws;
- Explain how individuals will be notified if adverse information is obtained during the process;
- Explain how long the information obtained will be retained;
- Explain how it will be destroyed at the end of the retention period.
It’s also important to dive a bit more into the third bullet point above and businesses will need to have a plan in place to identify what results will be considered disqualifying vs which will not. For example, if driving is not required for the specific role the candidate is being considered, it is strongly recommended that businesses not consider moving or parking violations as disqualifying. In addition to being consistent with the specific tasks the individual will be asked to perform, it also removes the potential risk of inequitable decision-making as some groups have a higher risk of having moving or parking violations than others, and considering those violations could add further harm to the individual without any benefit to the business.
Using appropriate background checks can reduce the risk of hiring or engaging with individuals who have a history of behavior that could negatively impact your business and reputation.
